By this First Appeal, appellant/plaintiff is challenging Judgment and Decree dated 10.04.2015, passed by learned Bombay City Civil Court, in S.C.Suit No.1641/2004, dismissing appellant's suit for declaration and injunction in respect of suit property.

Considering the submissions made by the learned counsel for appellant and impugned Judgment and Decree, following order is passed.
