The petition is directed against order dated 5th February, 2020 directing the petitioner to pay amount of Rs. 5,000/- (Rupees Five Thousand Only) per month to the daughter towards maintenance from the date of application till the final decision. Undisputedly, Nehal is the daughter of the petitioner. She has no source of income. The Family Court has recorded a finding based on admission of the petitioner that she is working and her monthly income is Rs.30,892/- to Rs.33,565/- per month. Considering the said reasons, learned Family Court directed the petitioner to pay amount of Rs.5,000/- (Rupees Five Thousand Only) per month as maintenance to the daughter. According to the learned advocate for the petitioner, rent of Rs.14,000/- (Fourteen Thousand) per month and the dependency of his ill father has not been considered by the learned Family Court.

In my opinion, taking into consideration the admitted amount of salary of Rs. 30,000/- to Rs. 33,000/- per month and

25-wp-9706-2022.doc rent of Rs.14,000/- (Rupees Fourteen Thousand Only), learned Family Court was justified in directing the petitioner to pay an amount of Rs.5,000/- per month. The amount of Rs.5,000/- per month cannot be termed as unreasonable. There is no merit in the writ petition.

The Writ Petition is, therefore, dismissed. No costs. (AMIT BORKAR, J.)
