By this petition, the petitioner seeks transfer of C.R.No.769 of 2022, registered with the Pant Nagar Police Station, Mumbai, to any other investigating agency or any other Police Station in the city of Mumbai.

Mr. Konde Deshmukh, learned Addl.P.P., on instructions, states that the Police have investigated the said case and after investigating the said case, under the supervision of the D.C.P. of the Wakodikar 1/2

36. WP 3489-2023.doc concerned zone, have filed chargesheet in the said case on 30th January, 2024. He further submits that investigation has, however, been kept open under Section 173(8) in the event additional evidence comes to light.

In view of the aforesaid, nothing survives for further consideration in the aforesaid petition.

It is open for the Police to continue with the investigation and take appropriate steps, in accordance with law, since investigation has been kept open under Section 173(8) of the Cr.P.C. 5.

The petition stands disposed of on the aforesaid terms. 6.

We make it clear that we have not gone into the merits of the petition and as such, all contentions of all parties are kept open. MANJUSHA DESHPANDE, J.
