1] The learned APP states that the statement of the complainant has been recorded by the Investigating Officer on 06.09.2022. In the said statement, he has specifically stated that settlement has been effected with him and he has returned old cheque of Rs.6 Lakhs, in lieu of which she has received the total amount of Rs.8.5 Lakhs.

2] The complainant is present in the Court and he state that he is satisfied with the amount that is received by him and he has no grievance. The complainant stated that he shall accord no objection for quashing of the FIR in case an appropriate application/petition to that 1/2

(8)ABA-540-2022.doc effect is filed. He, further, stated that he may be permitted to file Civil Suit, if advised, for seeking damages.

3] Keeping aforesaid remedy open, since the parties have settled the dispute amongst themselves, the Applicant deserves protection from arrest.

Hence, following order :

ORDER

(a) Application is allowed.

(b) In the event of arrest in connection with C.R.No.356/2022 registered with Vileparle Police Station, the applicant Paras Prataprai Vasa shall be released on bail on furnishing P.R. bond to the extent of Rs.50,000/- with one or more sureties of the like amount.

(c) The applicant shall report to the concerned police station as and when called for.

(d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and should not tamper with evidence.
