Learned counsel appearing for the respondent nos. 1 to 4 submits that there is a statutory remedy to file appeal and the petitioner may avail of the same. Learned counsel for the petitioner submits that the Armed Forces Tribunal at Mumbai is not available and, therefore, the petitioner has approached this court.

52-wp-1996-16 submits that the regular Bench of Armed Forces Tribunal at Mumbai, at present, is not available but the members of the Guwahati Armed Forces Tribunal will be sitting at Mumbai between 20/6/2016 to 24/6/2016. 3.
In this view of the matter, the petitioner may first resort to the statutory remedy as permissible in law.
