The Learned Counsel for the Applicants Shri. R. M. Nakhwa seeks withdrawal of the above Civil Revision Application to file a Second Appeal. This course of action the Learned Counsel states is required to be followed in view of the judgment of the Apex Court in Sheodan Singh Vs. Daryao Kunwar reported in 1966 SC 1332. The above Civil Revision Application is accordingly allowed to be withdrawn with liberty to file a Second Appeal. If the issue of limitation arises, the fact that the Applicants were prosecuting the instant Civil Revision Application in this Court can be urged by them.
