In this Public Interest Litigation, the Petitioner has raised several challenges to the method and manner in which the respondent no.3 Ulhasnagar Municipal Corporation is levying and recovering the property tax, particularly the levy of penalty/penal interest on unpaid property tax. 2.
The petitioner had made a representation dated 15 April 2014 to the State Government in Urban Development Department and to the Ulhasnagar Municipal Corporation. 3.
In the facts and circumstances of the case and having regard to the nature of the grievances made in the Public
2 of 2 PIL.143.2014 Interest Litigation, it would be in the fitness of the things to dispose of this PIL with a direction to the Ulhasnagar Municipal Corporation to decide the representation made by the Petitioner dated 15 April 2014 (Exhibit-A to the petition) as expeditiously as possible and preferably within two months from the date of receipt of this order. The PIL is accordingly disposed of in the above terms. It goes without saying that in case the decision on the Petitioner's representation is adverse to the Petitioner, the Petitioner will be at liberty to challenge the same by taking appropriate proceedings in accordance with law.
