The record clearly indicates that the applicant without approaching the Sessions Court at the first instance and has directly filed the aforestated applications under Section 438 of Cr.P.C. before this Court. Judicial propriety demands that the applicants should first approach the Sessions Court with an application for pre-arrest bail.

Facing with the said difficulty, the learned counsel for the applicants on instructions seeks leave to withdraw the present applications with liberty to file fresh pre-arrest bail
