P.C.:- The Applicant, Hemant Gulab Singh Rawat, has sent a letter through jail addressed to the Registrar of this Court praying therein to release him on furnishing personal bond. It appears that, the Applicant has been acquitted in Sessions Case Nos. 580 of 2008 and 817 of 2008. However, while 1/3
ssm 2 5-appa692.16.doc admitting the Appeal filed by the Original informant, action under Section 390 of the Code of Criminal Procedure was ordered by the High Court.
It appears that, though the Applicant has been acquitted, due to non-furnishing of surety to the satisfaction of the Trial Court, he is in jail, though acquitted in Sessions case Nos. 580 of 2008 and 817 of 2008. The applicant has requested to allow him to furnish the personal bond instead of furnishing the sureties. Keeping in view the prayer in his letter/Application addressed to the Judicial Registrar of this Court, we allow the Applicant to furnish PR bond of Rs.20,000/- and one surety of like amount before the Sessions Court, Mumbai.
With the above observations, the Application of the Applicant stands disposed off.
At this stage, the learned APP submitted that, the Applicant is shifted from Navsari Sub-jail, Gujarat to the Lajpor Central Jail, Surat, Gujarat. In that view of the matter, the Registry shall send a copy of this Order to the Superintendent of Lajpor Central Jail, Surat, Gujarat immediately, free of cost. 2/3
ssm 3 5-appa692.16.doc After release of the Applicant, he shall attend the Oshiwara Police Station, Mumbai once in a three months and to furnish his latest permanent address including his cell/mobile number to the said Police station.
