Learned A.P.P., on instructions from Superintendent, Nashik Road Central Prison, Nashik submitted that, the Petitioner has already undergone his sentence in CR No. 163 of 2010 for the offence under Section 379 read with 34 of Indian Penal Code (for short, "I.P.C.") and is now undergoing imprisonment for life in CR No. 99 of 2012 for the offence under Section 302 of I.P.C. registered with Shivadi Police Station, Mumbai. 2.

In view of the above, present Petition has become infructuous and is accordingly disposed off.
