The applicant has preferred this application for seeking direction to expedite the proceedings (Case No.3996/SS/2015) pending before the Metropolitan Magistrate, 26th Court, Borivali, Mumbai within a period of three months. The advocate for the applicant submitted that the applicant had also preferred an application for interim maintenance which was filed on 18th October, 2014. It is submitted that the said application was heard by the concerned Court and the application was kept for passing orders. However, the learned Magistrate who had heard matter was transferred to another Court. Now the said application will have to be heard a fresh by the concerned Magistrate. 1/2

Learned counsel for respondent no.7 submits that respondent no.7 has also preferred an application for dropping the proceedings under the Domestic Violence Act which is also pending before the said Court since January 2015.

In view of the above, learned Magistrate is directed to decide the application for interim maintenance as well as application preferred by respondent no.7 as expeditiously as possible. 4.

Considering the fact that the applications are pending for a long period of time, the trial Court is directed to decide the above applications within a period of three months from today. 5.

Application stands disposed of.
