DATED : 29th JULY 2021 P.C:- In furtherance of the order dated 17th July 2021, the complainant Sanika Sachin Gharat is personally present before the Court. She admit that she has received an amount of Rs.12,62,558/- from Raj Purohit, and the amount came to be transferred in her account by RTGS. This satisfies her claim in the complaint when she has alleged that she had invested the amount for purchase of a flat and had made payment towards the said flat.
The learned APP make a statement that Amol Bane, the witness has also been paid an amount of Rs.3,70,000/-. The said statements are accepted. In light of the said statement, the applicant is entitled to be released on bail in anticipation of his Tilak
2/2 28 ABA 1597-21.doc arrest, since the allegations levelled against him in the complaint which prompted the Khandeshwar Police Station to register an FIR by invoking Section 420 of the IPC along with Section 4A and 13A of the MOFA Act, was limited to the amount being invested by the complainant and by brother and sister-in-law towards the booking of the flat with the applicant. Hence the following order :-
O R D E R
(a) In the event of his arrest, the Applicant - Amrit Chellaram Purohit @ Raj Purohit in connection with C.R.No.210/19 registered with Khandeshwar police station, shall be released on bail on furnishing P.R. bond to the extent of Rs.50,000/- with one or two sureties of the like amount.
(b) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and should not tamper with evidence.
(c) The Applicant shall make himself available as and when required by the Investigating Officer.
