Heard the learned counsel for the Applicant.

The learned counsel for the Applicant submits that by this Civil Application, Applicant is seeking condonation of 40 days delay in filing First Appeal challenging the judgment and award dated 31.12.2012 passed by MACT, Raigad at Alibag in MACP No.128 of Mohite 1/2

The learned counsel for the Applicant submits that office note shows that Civil Application stands dismissed against Respondent no.1 owner of the vehicle by order dated 3.3.2015 passed by learned Registrar (Judicial-II). The learned counsel for the Applicant submits that he requires some time to take appropriate steps for restoration of Civil Application against Respondent no.1.

On his request, as a last chance, time is granted till 31.8.2019, failing which entire Civil Application shall stand dismissed without referring back to the court.

If appropriate steps are taken, matter to appear on board on 6.9.2019 for further orders.
