This is an application for suspension of sentence and for releasing the applicants/accused on bail during the pendency of the appeal filed by them. The applicants/accused are convicted of offences punishable under Sections 13(2) read with 13(1)(d) of the Prevention of Corruption of Act, 1988. They are sentenced to suffer rigorous imprisonment for two years apart from payment of fine.

Heard both sides and perused the impugned judgment and order of conviction and resultant sentence.

The substantive sentence of imprisonment imposed on the applicants has already been suspended by the learned Trial Court. The applicants have already deposited the fine amount. The appeal filed by them is not likely to be heard within short period. Therefore, the order;
:: ORDER ::
(i) The application is allowed.
(ii) The substantive sentence imposed on the applicants is suspended and they are directed to be released on bail on their executing P.R. Bond in the sum of Rs.15,000/- each and on furnishing surety by each of them in the like amount.
(iii) Four weeks time as prayed is granted for furnishing surety.
