By this petition under Article 226 of the Constitution of India, the petitioner is seeking direction against respondent nos.1 to 3 to recover amount of Rs.4,26,39,789/- (Rupees Four Crore Twenty Six Lakhs Thirty Nine Thousand Seven Hundred Eighty Nine Only) as directed by Special Auditor by way of order dated 12th March 2020.

21-wp-3473-2021.doc Advocate for the petitioner submitted that the petitioner may be permitted to withdraw the petition with liberty to file application before appropriate authority for execution of order dated 12th March 2020. Same is permitted.

4. Writ petition stands disposed of as withdrawn, with liberty to approach appropriate authority for execution of order dated 12th March 2020 passed by the Special Auditor.

5. All contentions of both the parties are kept open.

6. No order as to costs.
