The learned counsel appearing for the Petitioner on instructions of the Petitioner seeks permission to withdraw the Petition with liberty to serve a notice under Sub-section (1) of Section 49 of the Maharashtra Regional and Town Planning Act, 1966. The request is reasonable. Accordingly, we dispose of the Petition as withdrawn with liberty as prayed. All contentions on merits of the proposed notice to be given are kept open.
