IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 6998 OF 2016 Dronagiri Shikshan Sanstha Sanchalit Shishugruh (Adoption Centre) and anr.
... Petitioners v/s The State of Maharashtra ... Respondent Mr.Pradip Rajput for the petitioner.
Coram: N.M. Jamdar, J.
Dated: 3 October 2016 P.C.:
Not on board. Taken on production board in view of the praecipe filed by the Petitioners.
Heard learned counsel for the Petitioners.
The Petitioners have challenged the order dated 1 January 2016. Various prayers in the nature of mandamus of writ under Article 226 of the Constitution of Indian against the order passed by the learned District Judge have been sought, which are wholly misconceived. The main grievance of the Petitioners is that, after the order passed by the learned District Judge on 1 January 2016 directing the Petitioners to seek necessary permission from the
bsb 2 P6.WP6998.16.doc competent authority, the Petitioners have approached the competent authority, who has opined that it has no jurisdiction to grant such permission. If that is the case, the Petitioners can always apply to the learned District Judge for appropriate orders in view of the clarification given by the competent authority. Once this fact is brought to the notice of the learned District Judge, the learned District Judge will no doubt proceed further with the matter. Considering that the issue is of an adoption of a child, the learned District Judge will look into the grievance as expeditiously as possible. The writ petition is disposed of.
