Apprehending arrest in C.R. No. 314 of 2018

2/4 ABA-1085-2019 (SR.35) registered with Kapurbawadi Police Station, Thane applicant has applied for pre-arrest bail. One Vijay Shetty had floated a project called, Dream Constructions. Complainant, Smt. Jailakshami invested a sum of Rs.16,00,000/- and plus in the said project. It appears, Vijay Shetty had agreed to sell a flat in the said project. Applicants '

sister, Mayuri was an employee of Vijay Shetty. She is also accused in the subject C.R. Complainant alleged certain amount was paid by her to Mayuri. It is submitted that, Mayuri has been released on bail by this Court vide order dated 9th April, 2019, On her willingness to deposit Rs.1,31,000/- in the Registry of this Court. Counsel for the applicant, on instructions submits that, Rs.1,31,000/- has been deposited by Mayuri in this Court.

The role attributed to the applicant is that, he introduced Mayuri to Vijay Shetty. Except this, there are no allegations against this applicant.

In view of the facts stated hereinabove, the Anticipatory Bail Application is allowed. Hence, the following order.

(i).

In the event of arrest of the applicant in C.R. No. 314 of 2018 registered with Kapurbawadi Police Station, Thane, shall be released on bail on furnishing P.R.

Bond of Rs.25,000/- (Rs. Twenty Five Thousand only) with one or more sureties in the like amount.

(ii) The applicant shall attend the concerned Police Station as and when called.

(iii) The applicant shall inform his latest place residence and mobile contact number immediately and/or change of residence or mobile details, if any, from time to time to the Investigating Officer of the Police

(iv) The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

(v) The applicant shall attend the Police Station concerned as and when called.

Application is allowed in the aforesaid terms.
