IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION CIVIL APPLICATION NO.81 OF 2016 IN CONTEMPT PETITION NO. 125 OF 2016 Andrew Duming Vashalkar & Ors ..Applicants Vs.

Maruti Savaleram Sabale & Ors ..Respondents Mr. S. P. Thorat for the Applicants Mr. A. K. Roy a/w Ms Nisha N. Valani for the Respondents CORAM :

R. M. SAVANT, J.

DATE :

16th JANUARY, 2017 P.C.

The above Civil Application has been filed for joining the Applicant Nos.1 to 11 as parties to the above Petition as Petitioners. It is the case of the Applicants that they are similarly situated as the original Petitioners and are also entitled to the pension from the Respondents. In my view, though there is opposition from the Respondents of the Applicants being joined as the Petitioners, it would be just and proper to permit the Applicants to be joined as the Petitioners so as to avoid multiplicity of proceedings. The Civil Application is accordingly allowed, resultantly the Applicants are permitted to join as the Petitioners and would be numbered after the original Petitioners. Amendment to be carried out within two weeks from date. The Learned Counsel appearing for the Respondents states that mmj

caw-81-16-(11) the original Petitioners have still not made compliances of the requisitions made by the Respondents so as to facilitate the fixation of grant of pension. If that be so, the original Petitioners as well as the Applicants who are now joined as the Petitioners may make the necessary compliances. The Learned Counsel appearing for the Petitioners Mr. Thorat states that the forms in question have been filled and submitted to the Respondents. The Learned Counsel for the Respondents may therefore verify and inform the Learned Counsel for the Petitioners if there are any shortcoming. Place the Petition for admission on 27-2-2016. The Civil Application is accordingly disposed of. [R.M.SAVANT, J] mmj
