This is the third bail application filed by the aforesaid applicant, who is facing trial in Special Case No. 188 of 2020 pending on the file of Special Judge (POCSO), Kalyan.

Learned Counsel for the applicant states that it is a case of love affairs between a girl of 14 years and boy of 22 year. The victim is a child within the meaning of Section 2(d) of Protection of Children from Sexual Offences Act, 2012. Furthermore, learned APP states that the trial has concluded and that the matter is now listed for recording the statement under Section 313 of Cr.P.C. In the light of which, I am not P P SALGAONKAR
