Heard learned counsel for the parties.

By this Application, the Applicant seeks pre-arrest bail in connection with C. R. No. 481 of 2018 registered with the Amboli Police Station, for the alleged offences punishable under Sections 354 & 506 of the Indian Penal Code and under Section 8 of the Protection of Children from Sexual Offences Act ( for short 'POCSO' ).

According to the Complainant, the Applicant outraged

the modesty of her daughter, aged 11 years, by inappropriately touching her. It appears that during the course of investigation, the victim girl's statement under Section 164 Cr.P.C. was recorded. A perusal of the 164 statement shows that it was the victim's mother and her friend - Aziz, who had threatened her to make allegations against the Applicant 4.

Considering the aforesaid, the Application is allowed and the Applicant is granted pre-arrest bail on the following terms & conditions :-

O R D E R

(i) In the event of arrest, the Applicant be enlarged on bail, on executing PR Bond in the sum of Rs. 10,000/- with one or two sureties in the like amount;

(ii) The Applicant shall report to the investigating officer of the concerned police station as & when called for by the investigating officer;

(iii) The Applicant shall co-operate with the investigation. 5.

The Application is allowed in the aforesaid terms and

is accordingly disposed of.
