Heard the learned APP. Perused notes of evidence, more particularly, the substantive evidence of PW1 Bhimrao Kale. PW1 has deposed before the Court that Nilesh, who is Respondent No.3 in the present case has assaulted him on his face with a stick. Due to which, he lost is teeth. The said evidence is corroborated by PW7 Dr. Geeta Kulkarni, who has examined Bhimrao Kale- PW1 on 4.5.2009. According to her, the injury sustained by Bhimrao Kale are as follows:

(i) Loss of Incisor (ii) Upper right incisor and canon.

(iii) I noted fresh bleeding from the said injury. (iv) Left eye black.

(v) CLW on right hand, its size was 2x2x2 cms. The injury No.1 was grievous in nature.

In view of the above, the appeal deserves to be admitted as far as Respondent No.3 is concerned. However, the appeal against Respondent Nos.1,2, 4 and 5 is dismissed. Call for R & P. [SMT.SADHANA S. JADHAV, J.] V.A. Tikam
