Mr. Nikam, learned Counsel appearing for the Petitioner at the outset submitted that relief claimed in prayer clause (a) is rendered infructuous inasmuch as the Petitioners were released yesterday. In this regard, Mr. Yagnik, learned APP submitted that action was taken against the Petitioners under section 69 of the Maharashtra Police Act and they were never arrested and they were allowed to go yesterday.

In above circumstances, learned Counsel appearing for the Petitioner seeks leave to withdraw the writ petition with liberty to pursue the appropriate remedy in respect of the relief claimed in prayer clause (b).
