1] This appeal takes an exception to the order dated 07.07.2021 passed by the learned 2nd Civil Judge, Senior Division, Pune, below Exhibit 76 in Special Civil Suit No.736 of 2021. 2] An application at Exhibit 5 filed by the Petitioner-original Plaintiff in the aforesaid Suit under Order 39 Rule 1 and 2 of the Civil Procedure Code was allowed by the trial Court by order dated 05.07.2021. An application thereafter was filed at Exhibit 76 by the Respondents inter alia praying that the order dated 05.07.2021 be stayed for 30 days to enable them to file appeal against the said order and to obtain appropriate orders from the appellate Court. The trial Court allowed the said application by the order impugned dated 07.07.2021.
