This is an application for bail. The applicant is arrested on 25 January, 2017 in connection with C.R. No.41 of 2017 registered with Dahisar Police Station, Mumbai for the offences punishable under sections 354, 354(A) of IPC and under sections 8 & 12 POSCO Act. 2.

It is the prosecution case that the applicant was teacher in the school where he has committed the alleged offence. It is alleged that the applicant had indulged in outraging the modesty of the minor student.

Learned advocate for the applicant submitted that the applicant is in custody from 25 January, 2017. The applicant has 1/3

Vina k sr.912.ba.1255.2017.doc been suspended from the school. He submitted that on completion of investigation, the chargesheet has been filed and further custody of the applicant is not necessary.

Learned APP opposed the application for bail. He submitted that applicant has committed serious crime and is involved in outraging modesty of the minor student. He, therefore, submitted that the application for bail may be rejected. 5.

I have perused the FIR and the other documents on record. The offence was registered on 25 January, 2017. The applicant was arrested on same day. He has been suspended from school. The investigation is complete and the chargesheet has been filed. The trial will not commence immediately. Taking into consideration the aforesaid circumstances, the applicant can be released on bail. 6.

Hence, I pass the following order;

:: ORDER ::

(i) The applicant is directed to be release on bail in connection with C.R. No.41 of 2017 registered with Dahisar Police Station, Mumbai on furnishing P.R. Bond in the sum of 2/3

Vina k sr.912.ba.1255.2017.doc Rs.30,000/- (Rupees Thirty Thousand only.) with one or more sureties in the like amount.

(ii) The applicant is directed to attend Dahisar Police Station, Mumbai once in fortnight on every Saturday between 10.00 am to 12 p.m. till further order.

(iii) The applicant is directed to stay out of the jurisdiction of the Dahisar Police Station, Mumbai and he will not enter the said jurisdiction except for the purpose of attending the police station as directed.

(iv) Application stands disposed of.
