DATED : 6th AUGUST, 2021 P.C:- In light of the earlier order, the learned APP has placed on record the Medico Legal certificate issued by C.S.M. General Hospital Solapur. It record that Siddram was brought to the hospital at 2.30 am on 4th March 2021 with history of assault on the previous day. The certificate, however, record that there is no internal injury seen. A remark is also put in the certificate that patient is discharged against medical advise without any further investigation and examination. Type of injury cannot be given. In wake of the said certificate produced on record, when the allegations against the present applicant is that the Tilak
2/2 19 ABA 1691-21.doc applicant had picked up a brick and hit the complainant in his face, prima facie do not receive any corroboration. In these circumstances, the applicant is held entitled to be released on bail in the event of his arrest. Hence, the following order :-
O R D E R
(a) In the event of his arrest, the Applicant - Gautam Madhukar Kasabe in connection with C.R.No. 97 of 2021 registered with Jodbhavi Peth Police Station shall be released on bail on furnishing P.R. bond to the extent of Rs.25,000/- with one or two sureties of the like amount.
(b) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and should not tamper with evidence.
(c) The Applicant shall report to the Police Station as and when called by the Investigating Officer.
