The Petitioner is aggrieved by the notice dated 28th March 2018 issued to the Editor of the Film which the Petitioner has produced. In our view, during the course of the investigation of the offence, which is alleged against the Petitioner in the FIR lodged by the first informant, the police are entitled to adopt such measures as are necessary. Towards that end, the notice to the Editor has been issued by the Investigating Officer. The said notice has been issued to investigate into the veracity of the allegations made in the FIR as regards the portrayal of SQ Pathan 1/2
wp.2308.18.903.doc the Petitioner in the film. No interference is therefore called for with the action taken by the Police. Insofar as the quashing of the FIR is concerned, we are of the view that the said relief sought, is premature as the investigation is still in progress.
We, therefore, decline to exercise our writ jurisdiction. The Writ Petition is accordingly dismissed.
