Heard the learned counsel for the Applicant (original accused no.2) and the learned A.P.P. for the State. The applicant (original accused no.2) is a convict of the offence punishable under section 420 read with 34 of the Indian Penal Code. It appears from the evidence that there is a possibility of the applicant being also one of the victims of the offence allegedly committed by accused no.1. In the circumstances, I pass the following order :
i.
The Applicant be released on bail in the sum of Rs. 35,000/- (Rs.Thirtyfive thousands only) with one solvent Borey 1/2
spb/ 903appr243-15.sxw surety in the like amount or a cash deposit of Rs. 35,000/- in lieu of surety.
ii.
Substantive sentence imposed on the applicant shall remain suspended during the pendency of the revision application.
This criminal application stands disposed of in the above terms.
