Heard Mr. Menezes, the learned counsel for the petitioners and Mr. Nagvenkar, the learned APP for respondent Nos.1 to 4. 2.

The petition is instituted seeking a mandamum to extend the period of parole, on which the petitioners were ordered to be released, to 90 days.

The learned APP informs the Court that the Competent Authority has extended the period of emergency parole qua petitioner No. 2-Shri Vicky Sharma and petitioner No. 3-Shri Pradeep Harwalkar to 90 days, whereas the petitioner No.1 has surrendered after the expiry of the initial period of parole leave. In view of the aforesaid statement, Mr. Menezes, the learned counsel for the petitioners, on instructions, submits that nothing survives in this petition for further consideration. 5.

Mr. Menezes further submits that petitioner No.1-Shri Janardhan Kokre has fled a fresh application for release on parole.

In the aforesaid view of the matter, the petition stands disposed of at it has served its purpose.

We clarify that the disposal of this petition may not be construed as an impediment for the authorities to decide the application of petitioner No.1 for release on parole, on its own merits.
