Mr. N. K. Rajpurohit, AGP for Respondent Nos.2 to 5 (State). __________ CORAM : A. S. CHANDURKAR & JITENDRA JAIN, JJ.

DATE : 27th MARCH 2024 P.C.:

1.

None for the Petitioner.

2.

On 17th October 2023, leave was granted to the Petitioner to amend the cause title to indicate the correct description of Respondent No.1. By the said conditional order, it was directed that if the amendment was not carried out within a period of three days, the Writ Petition would stand dismissed against Respondent No.1. The office note shows that the amendment was not carried out and hence the Writ Petition now stands dismissed against Respondent No.1. It is seen that Respondent No.1 was the Original Applicant before the Maharashtra Administrative Tribunal in Original Application No.1088 of 2010. By the

Tauseef 915-WP.7290.2014.doc judgment dated 7th April 2014, the Original Application was allowed and the relief as prayed for by Respondent No.1 was granted. Since the Writ Petition has been dismissed against Respondent No.1 by virtue of the conditional order dated 17th October 2023 and no further steps have been taken, the Writ Petition in its present form cannot be adjudicated on merits, since the successful party-Respondent No.1 is not on record. 3.

Hence, the Writ Petition stands dismissed with no order as to costs.
