--- CORAM :SMT.SADHANA S. JADHAV,J DATE :JUNE 24, 2016 P.C.:- This is an application for restoration of the Writ Petition, which was dismissed for noncompliance of the order dated 12/2/2016. The Petition is of the year 2014. None appears for the 1/3

petitioner on several occasions such as 8/12/2014. This Court had issued notice on 6/10/2015 and it was directed that the pendency of this Petition shall not be construed as a stay. Conditional order was passed on 12/2/2016, which was not complied by the Petitioner. However, in the interest of justice, the application seeking restoration deserves to be allowed with condition that the petitioner deposits cost of Rs. 1,000/- in this Court within one week from today.

It is once again clarified that pendency of this petition shall not be construed as a stay to the proceedings in R.C.C No. 1559 of 2013 pending before the Judicial Magistrate First Class. Pune. Learned Magistrate shall proceed with the matter forthwith. Office to communicate this order to the concerned court forthwith.

Cost of Rs. 1000/- be paid in this Court within one week from today.
