This Application for condonation of delay is pending since 2004, as Union of India has not taken steps to serve notice on respondent no.1-EMCO Transformers Ltd.

This Appeal is filed against the award dated 16th September, 2003 passed by the learned Member (Tech.) of Railway Claims Tribunal, Mumbai Bench, Mumbai thereby directing that the applicant, i.e. respondent No. 1, is entitled to receive compensation of Rs.18,265/- along with cost and interest @ 6% p.a. No steps are taken by Union of India. The Civil Application was dismissed earlier and again it was restored in 2007. The bhatta charges was paid by 1 / 2

3.CAF3303_2004.doc Union of India. On 5th October, 2009, this Court has directed the applicants to take steps against unserved respondent No. 1 within six weeks, however, no steps are taken.

In view of this, First Appeal is dismissed.
