P.C.:- This is an Application for condonation of delay of 3 years and 99 days (1193 days) in filing the present Appeal against the conviction. Learned appointed Advocate submitted that, on the date of pronouncement of Judgment and Order the Applicant was taken into custody and therefore he could not engage an Advocate to file Appeal within the period of limitation. He submitted that, after the Applicant sent a letter to the High Court Legal Services Committee, Mumbai he has now been appointed to represent the Applicant and therefore delay has occurred in filing the present Appeal.

Perusal of Application would indicate that, sufficient case is 1/2

In view thereof and for the reasons stated in the Application, delay is condoned and Application is allowed in terms of prayer clauses (a) and (b).
