The Remarks column in the cause list indicates that this Appeal has been dismissed as against Respondents No.5 and 6. Ms.Chavan, learned Counsel for the Appellant - Insurance Company, would submit that since Respondent no.5 is the insurer avk 1/3

and Respondent no.6 is the driver, it would not be necessary to restore the Appeal as against them and the Appeal can proceed without the two Respondents.

Mr.R.J.Deshmukh holding for Mr.Dnyaneshwar Deshmukh, submits that the learned Counsel has suddenly taken ill and unable to attend to the matter.

Learned counsel for the parties are at liberty to circulate brief propositions and supporting judgments.

CIVIL APPLICATION NO.2222 OF 2012 1.

This is an application seeking stay to the execution of the impugned judgment and order. Learned Counsel for the applicant submits that an amount of Rs.2,25,509/- was deposited on 13th December 2013 and the ad-interim stay granted on 3rd January 2013 be continued and the application be disposed of. avk 2/3

Having heard the learned Counsel and having perused the record, let the stay continue till the final disposal of the Appeal. 3.
