On 16/06/2022, this Court granted ad-interim protection in favour of the applicant subject to deposit of an amount of Rs.25,00,000/- with the complainant, which I am informed is already complied with. Subsequent thereto, on 22/06/2022 this Court continued ad-interim protection, so also on 03/08/2022. 3.

As a sequel of above orders, what is noticed is an amount of Rs.54,00,000/- is deposited by the applicant with complainant, which is subject matter of the offence in question. 4.

The prosecution case against the applicant is, of having accepted the aforesaid amount with a promise to deliver the akn 1/2

2/2 911.ABA.14.2022.doc property, however the said promise was not adhered to. 5.

Since the applicant has shown his bonafide by depositing the entire amount, in my opinion custodial interrogation of the applicant is not required. That being so, ad-interim protection stands confirmed.

In the event of arrest of applicant in crime no. 47 of 2022 registered with Khandeshwar police station for the offence punishable under section 420, 406 & 506 of IPC, applicant be released on bail on furnishing P.R. bond in the sum of Rs.25,000/- with one or more sureties in the like amount. 7.

The applicant shall neither tamper with evidence nor influence the witnesses in any way.

The application stands disposed of.

However, this order does not preclude the complainant from moving before the Civil Court for recovery of damages/ compensation from the applicant.
