This application is taken out in the disposed of writ petition seeking stay of further proceedings before the Metropolitan Magistrate, 48th Court, Andheri, Mumbai as also for relaxation of condition of time frame for conclusion of the case pending before the trial Court. 2.
Learned counsel for the petitioner states that prayer (b) is not pressed. Accordingly, the only request made today is that the direction to the trial Court to conclude the matter on or before 9th June, 2017 should be extended. In view of the fact that under the settlement arrived at between the
2 14.appw263.17 parties in the consent terms, a copy of which is annexed to the application the last payment is due on 31st December, 2017. Learned counsel requests for extension of time for disposal of the matter before the trial Court. In the circumstances the parties are at liberty to approach the trial Court which they will do within one week from today. If the parties approach the trial Court with the aforesaid to file consent terms, the Court will consider the same in accordance with law and would endeavor to dispose of the matter within one month from payment of the last installment. It is made clear that the trial Court may fix matter in its discretion but in any event will endeavor to dispose of within one month of payment of last installment which is due on 31st December, 2017.
