Heard learned counsel appearing for the Applicant and the learned counsel appearing for the Respondent.

Civil Application No.230 of 2015 for restoration of the Appeal has been dismissed for nonprosecution by an order dated 27th April 2016. The present Application is for restoration of the said Civil Application.

The Application is opposed by the learned counsel appearing for the Respondent. He pointed out that taking the benefit of leniency shown by the Court to the Applicant, the Applicant has remained absent on several dates. She did not appear before the learned Mediator.

Nevertheless, the Application made by the Applicant has been dismissed as the Advocate appointed by the Applicant was not present. The Application discloses that from 31st March 2016 to 19th May 2016, the Advocate for the Applicant was at his native place.

Accordingly, the Application is allowed in terms of prayer clauses (a) and (b).
