Heard Mr. Lokesh Zade, learned counsel for the petitioner and Mr.A.R.Metkari, learned counsel for respondents no. 1 and 2. 2.

By this Petition under Article 227 of the Constitution of India, the petitioner has prayed for the following relief: "(a) This Hon'ble Court be pleased to issue directions to respondent no.4 to pay to the petitioner an amount of Rs.24,29,123/- (Rs.Twenty Four Lacs Twenty Nine Thousands and one Hundred Twenty three only) in addition to the amounts already determined and decreed under the orders passed by 3rd respondent and 2nd respondent vide order dated 25.2.2015 and order dated 23.12.2015 respectively, under the provisions of the Maharashtra Rent Control Act, 1999;"

Perusal of this prayer clause (a) shows that the petitioner has claimed direction against respondent no.4 to pay amount of Rs. 24,29,123/- in addition to the amounts already determined as per orders dated 25.2.2015 passed by the third respondent and

2 / 2 WP/6868/2016 23.12.2015 passed by the second respondent under the provisions of the Maharashtra Rent Control Act, 1999. 4.

After arguing the Petition for quite some time, Mr. Zade, upon taking instructions from Prahlad Kumar Ajwani, husband of Smt. Uma Ajwani, Constituted Attorney of the petitioner who is present in the Court, seeks permission to withdraw this Petition with liberty to adopt appropriate proceedings for claiming reliefs in terms of prayer clause (a). Mr. Zade has tendered photocopy of Aadhar Card of Prahlad Kumar Ajwani, husband of Smt. Uma Ajwani, Constituted Attorney of the petitioner, which is taken on record and marked 'X' for identification.

On the motion made by Mr. Zade, Petition is allowed to be withdrawn with liberty to the petitioner to adopt proceedings including suit or to make appropriate application, before Competent Authority for the reliefs claimed in this Petition. Petition is allowed to be withdrawn with liberty as prayed for. It is made clear that I have not examined the merits of the case. All contentions of the parties on merits are expressly kept open.
