By a reasoned Order dated 18.6.2018 the applicant was granted interim relief.

The record of investigation clearly indicates that the applicant had in prior point of time on 9.2.2018 lodged the first information report against the first informant herein under Section 354-A and 354-A(2) of the Indian Penal Code and the present crime has been registered by the first informant on 14.2.2018.

The learned APP on instructions submitted that, there are two witnesses who assertively supported the first Page-1/2

14-aba-1046-18.doc informant that they have in fact given certain amount to the applicant for depositing the same in Prerana CoOperative Credit Society however, the same has not been deposited.

After perusing the record, this Court is of the view that the present crime as lodged against the applicant is a counter blast to the crime registered against the first informant by the applicant and the version narrated herein is exaggerated leading to draw adverse inference that the present crime is lodged only to falsely implicate the applicant.

In view thereof, interim relief granted by Order dated 18.6.2018 is hereby confirmed.
