By a reasoned order dated 16th June, 2017, the applicant was granted interim relief.

Heard the learned Counsel for the applicant, the learned Advocate for the first informant at greater length and the learned APP. Perused the record of investigation. 2.

In furtherance of submissions made by the learned Counsel for the first informant which have been recorded in the order dated 16th June, 2017, the Investigating Officer has carried out the investigation and has also verified the 1/2

3-ABA985-17.DOC alleged CCTV footage which the first informant has pointed out to him and it is revealed that, the applicant was not present at the scene of offence on the date and at the particular time of incident. In view thereof, the applicant is entitled to be protected by the pre-arrest bail. 3.

Interim relief granted by Order dated 16th June, 2017 is hereby confirmed. However, the condition to attend the Investigating Officer of concerned police station is waived. 4.

Application is accordingly allowed.
