Heard learned Counsel for the Applicant and learned App. 2.
Learned Counsel for the Applicant submitted that bail has been granted to Applicant by this Court (Coram :Revati Mohite Dere, J. ) by an Order dated 27.01.2021. While allowing the bail application, this Court has imposed condition No.(iii) that the Applicant shall not leave the jurisdiction Mumbai, Thane and Palghar, without the prior permission of the trial Court.

Learned Counsel for the Applicant further submitted that Applicant is a businessman and he has to visit to other towns for his business purpose, it is finding difficult for him to take permission of trial Court every time to go outside. Hence requested to allow the Application.

Learned APP submitted that it is not necessary to relax the said condition, as Applicant may abscond and trial may be delayed. 5.
I have heard both the learned Counsel.

As the Applicant is a businessman and he has to visit other towns, every time it is finding difficult for him to take permission of the trial Court. He is the resident of Thane and his business is situated at Kalyan.

In view of the above, I pass the following Order: (i) Condition No. (iii) of Order dated 27.01.2021 is relaxed. (ii) Application is allowed.
