The learned Counsel for the petitioner submits that the petitioner has filed a separate suit before the City Civil Court, Borivali Division at Dindoshi (Goregaon) challenging the decree. He further submits that the Petition has become infructuous and, therefore, he seeks permission to withdraw the Petition.

The learned Counsel for the petitioner is allowed to withdraw the Petition.

Writ Petition is dismissed as withdrawn.
