This is an application filed seeking temporary bail for a period of one week for attending the wedding of brother of the applicant which is scheduled on 30th May 2023 at 1.32 p.m. at Urali Kanchan, Pune.

The applicant is being prosecuted for the offences punishable under Sections 302 read with Section 34 of the Indian Penal Code, Section 135 of the Bombay Police Act and Section 25 of the Indian Arms Act, 1969. The petitioner has been denied regular bail. The Sessions Court has rejected the

Rane 2/2 9-BA-1329-2023 applicant's application for temporary bail on 17th May 2023. 3.

When the application was listed on 24th May 2023 the same was adjourned in order to enable Mrs. Tidke, to take instructions as to whether the wedding of petitioner's brother is indeed scheduled to be held on 30th May, 2023. Mrs. Tidke, upon taking instructions from the concerned officer confirms that the wedding of applicant's brother is indeed scheduled to be held on 30th May 2023.

Considering the offences against the applicant, it would be inappropriate to grant temporary bail to the applicant. However, the applicant can be permitted to attend the wedding in police escort. The learned Counsel for the applicant submits that the applicant is willing to bear the costs of police escort. Hence, the following order : (i) The applicant is permitted to attend the wedding of his brother, Suraj scheduled to be held on 30th May 2023 at 1.32 p.m. at Alankar Hall, Shree Prayagdham Phata, Urali Kanchan, Pune Solapur Highway, Taluka-Haveli, District-Pune during 9.00 a.m. to 5.00 p. m. under police escort. (ii) The applicant to deposit the cost of police escort with the Superintendent of Prison, Yerwada Prison on/or before 29th May, 2023.
