The prosecution has sought leave to challenge the Judgment and Order dated 15th March, 2017 whereby the learned Addl. Sessions Judge , Pune has acquitted the respondent of the offences under Section 7, 13(1)(d) r/w. 13(2) of Prevention of Corruption Act.

Heard learned APP for the State and the learned Counsel for the respondent. Perused records.

The records prima facie reveal that the learned Special Judge has acquitted the accused mainly because of discrepancy in place of demand as deposed by the complainant and the panch witness. 4.

In my view, arguable points are raised. Hence leave granted.
