Rule. Learned counsel for the respondent no.1-State as well as the respondent nos.2 and 3 waive service. Heard finally by consent of parties.

By this petition filed under Article 226 of the Constitution of India, the limited prayer is made in this petition by the petitioner to direct the respondent-university to allow the petitioner to pursue the further course namely B.Sc. Bio-technology (Entire CBSE) and to permit the petitioner to attend the classes and other allied academic/ practical activities.

Learned counsel for the respondent no.2 university states that in view of the petitioner having failed in two subjects and passed in

ppn 2 30.wp-2997.21.doc remaining subjects, she will be permitted to appear for the Sixth Semester of the said course and to re-appear for the subjects which she has failed in the second revaluation. Statement is accepted. 4.

In view of the above, nothing survives in this petition. The petition is accordingly disposed of in aforesaid terms. Rule is made absolute accordingly. There shall be no order as to costs. R. I. CHAGLA J.
