The present application was taken out challenging the order dated 30th May, 2017 rejecting the request for extension of time to deposit a sum of Rs.1 lakh during pendency of the appeal. Appeal No.187 of 2017 is still pending before the Sessions Court and now listed on 15th June, 2017. In the meanwhile in view of the learned counsel for the applicant submits that due to severe financial difficulties monies could not be deposited. However, the applicant is willing to deposit the sum within a period of one week from today. The only relief she seeks is extension of time to deposit in the original appeal. By virtue of the impugned order suspension of sentence was also set aside and the registry was free to take necessary action. 2.

Respondent No.2 is present in person. He states that he has been

2 902.apl557.17 served only yesterday. In the circumstances the time to deposit the sum of Rs.1 lakh is extended upto 16th June, 2017. In view of time being extended as aforesaid, the impugned order setting up suspension of sentence is restored. No action will be taken by the Magistrate till further orders of the Sessions Court in the main appeal. Criminal appeal disposed of on the above terms. (A.K. MENON, J.)
