Heard the learned Counsel for the Petitioner. Learned Counsel upon instructions seeks liberty to withdraw the petition. Liberty as prayed for is granted in the interest of justice. It is made clear that all contentions are kept open.

Learned Counsel for the respondent submits that the Petitioner has filed a suit for seeking direction to be issued to the Corporation to take appropriate action for demolition of the construction by which the easement right of the Petitioner are disturbed and prejudiced. It is made clear that the civil court or any other court shall not be influenced by the observations made by the Ad-hoc Additional Sessions Judge, Greater Bombay in the order dated 8/5/2013 passed in Revision Application No. 72/2012.

Writ Petition stand dismissed as withdrawn and disposed of accordingly.
