Heard Mr.Kunal Damle, learned Counsel for the applicants and Ms.Yogini Gada, learned Counsel for the respondents.

Mr. Damle has handed over draft amendment so as to implead Shantabai Nanji Visaria, as respondent No.2, in above application. Ms. Gada has no objection. In view thereof, by 1 / 3

consent, leave to amend as prayed for is granted. Amendment shall be carried out forthwith.

Learned Counsel appearing for the parties have tendered consent terms duly signed by the applicants as also the respondents, including the newly added respondent No.2 as also their Advocates. Same is taken on record and marked as 'X', for identification. Mr. Damle states that all the applicants are present in Court. He has tendered photo-copies of their identity cards, which are taken on record and marked 'Y collectively' for identification.

Ms.Gada states that both the respondents are present in the Court. She has tendered photo-copies of their identity cards, which are taken on record and marked 'Z collectively' for identification.

Parties admit and confirm the correctness of the consent terms. Learned Counsel appearing for the parties submitted that Civil Revision Application may be disposed of in terms of the consent terms by accepting undertakings given in paragraphs-6 and 7 of the consent terms.

After perusing the consent terms, I am satisfied that 2 / 3

the controversy between the parties is lawfully settled in terms of the consent terms. Learned Counsel for the parties further state that the release deed annexing consent terms will be registered in accordance with law.

In view thereof, Civil Revision Application is disposed of in terms of the consent terms. Undertakings given by the parties in paragraphs-6 and 7 of the consent terms are accepted. Order accordingly.
