The petitioner herein seeks the prayer of traveling to Bali, to be in the company of his family from 15th June, 2016 to 20th June, 2016. 3.

The learned counsel for the petitioner submits that although it is true that the investigation of Crime No.77 of 2007 is in progress under Section 173 sub-clause (8) of Cr.P.C., the petitioner has co-operated with the investigation and would continue to do the same after he returns from

It is further submitted that on the earlier occasions also he was granted permission by the Courts to travel abroad and he has not committed breach of any conditions imposed upon him. It is further fairly submitted that before the Addl. Metropolitan Magistrate, 19th Court, Esplanade, Mumbai, the petitioner had voluntarily prayed that the deposit of Rs.10,00,000/- shall continue for a period until further directions from the Court.

Taking into consideration all these aspects, it would be expedient in the interest of justice to permit the petitioner to leave India during the period 15th June, 2016 to 20th June, 2016. 5.

The learned counsel for the petitioner, upon instructions, submits that on 21st June, 2016, the petitioner would appear before the Court of Metropolitan Magistrate and mark his presence. It is in this eventuality the petition deserves to be allowed in terms of prayer clause (ii). Rule is made absolute. Petition stands disposed of. 6.
