The Civil Application No. 2432 of 2015 is moved for withdrawal of the amount which was awarded by the judgment and award dated 23rd January, 2014 passed in M.A.C.P. No. 699 of 2011 by Motor Accident Claims Tribunal, Nashik. By the said judgment and award, the Tribunal has granted the compensation of Rs. 24.15 lacs Vishal 1 / 2

908-fa-893-2014.doc and out of the said compensation amount, it was directed that Rs. 3,15,000/- to be paid to Applicant No. 1 and Rs. 7,00,000/- to be deposited in the name of Applicant No. 1 in fixed deposit and Rs. 7,00,000/- to be deposited in the name of Applicant Nos. 2 and 3 each.

Perused the judgment and award. Heard both the learned counsel for the parties. The Applicant is the widow having two minor children. She is allowed to withdraw the amount of Rs. 3,15,000/- along with the interest accrued thereon.

Accordingly, Civil Application No. 2432 of 2015 stands disposed of.

First Appeal No. 893 of 2014 will be disposed of finally on 4th December, 2015.
